2. ABOUT WANDERLOOP

Wanderloop is a digital platform that connects travelers with local hosts to curate personalized trips and exceptional experiences with a genuine local perspective, all while embracing sustainable tourism practices. Our aim is for you to embark on a trip that mirrors that of a local, simultaneously enriching local businesses along the way. Moreover, we create opportunities for individuals aspiring to become local hosts, enabling them to unveil the magic of their cities and contribute to people lives. 

Wanderloop is an intermediary platform that seeks to connect travelers with hosts.

3. DEFINITIONS

  1. Wanderloop: Company dedicated to organizing personalized trips and providing experiences through local hosts from a local and genuine perspective.
  2. Traveler: Natural person who, as final recipient, uses the WANDERLOOP Platform to acquire the services offered.
  3. Wanderloop Platform: Virtual platform made up of a web page through which local hosts offer services to be acquired by the Traveler.
  4. Personal Data: It is all information that allows to identify or make identifiable a natural person.
  5. Owner: Natural person whose Personal Data is subject to Treatment.
  6. Treatment: It is any operation or set of operations on Personal Data, such as collection, storage, use, circulation or deletion
  7. Host:Natural person who provides services through the Wanderloop Platform.

4. PURPOSE

These Terms and Conditions govern the authorization of use that Wanderloop grants to the Traveler so that they can enter the Wanderloop Platform, and find out about the services displayed.

5. ACCEPTANCE OF TERMS AND CONDITIONS

The Traveler declares and understands that:

  1. You have read, understand and agree to be bound by these Terms and Conditions;
  2. The Traveler is of legal age, this means that he is at least 18 years old or is a company, organization or other legal entity duly constituted and existing in accordance with the laws of the country in which he is domiciled;
  3. Is in legal capacity of entering into contracts of any nature.
  4. In case of taking additional participants to your trip or experience, these additional ones accept and guarantee that they have read and accepted these Terms and Conditions, as if the term «You» were a reference to the participants.
  5. If you do not agree to these Terms and Conditions, you may not access and/or use the Wanderloop Platform.
  6. These Terms and Conditions must be read together with the Cancellation Policy and the Privacy Policy, as they are part of this document.

6. OPERATION OF THE WANDERLOOP PLATFORM

The Wanderloop Platform is a virtual intermediation platform, through which Travelers receive personalized and curated trips as well as find different experiences, as well as connect: (i) Travelers; and (ii) the Hosts. Through the Wanderloop Platform, Hosts can display their services, so that they can be acquired by the Traveler.

7. JURISDICTION

These Terms and Conditions are governed by the law in the Republic of Colombia.

8. AMMENDMENTS

Wanderloop may independently and at any time modify formal, procedural or substantial aspects of these Terms and Conditions of use of the Wanderloop Platform.

9. WANDERLOOP PLATFORM AVAILABILITY

Wanderloop does not guarantee the availability or uptime of the Wanderloop Platform. In case of instability or major technical inconveniences, Wanderloop will not have any responsibility towards the Traveler.

10. DATA PRIVACY

In accordance with the provisions of Law 1581 of 2012 and Decree 1377 of 2013 and other legislation that modifies, complements or adds to the personal data protection legislation of the Republic of Colombia, it is reported that Wanderloop will carry out the treatment of personal data in accordance with the aforementioned current legislation, for which the participants grant their consent and/or declare that they have the authorization of the respective owners, in order for Wanderloop to process personal data.

11. CONFIDENTIALITY

The information that Wanderloop receives or to which it comes to have access as a result of the Traveler’s registration in the Wanderloop Platform, will correspond to confidential information or material of exclusive property of Wanderloop, consequently Wanderloop will keep all the confidential information to which it accesses in strict confidentiality, which may not be revealed, published, disclosed, or made available to anyone, directly or indirectly.

12. PAYMENT METHOD

Wanderloop clarifies that Hosts set their own experience fees, and these are the payment for their services. The Hosts may change the prices of the Experiences without prior notice until the respective reservation has been confirmed. The prices of the experiences and/or tours include all taxes.

All payments to Hosts must be made through the Wanderloop Platform. Payment will be made through the payment channels available on the Wanderloop Platform.

Wanderloop states that credit card information is not stored within the Wanderloop Platform, likewise informs that it uses a third-party service to process your payment information for all transactions made through the Wanderloop Platform, therefore the Traveler authorizes Wanderloop and its payment service providers to process payments.

Each trip or experience is in its default currency, for which the Traveler may choose to make the payment in another currency taking into account the availability and/or options found on the Wanderloop Platform.

Once an experience or trip is booked, this value will be maintained, regardless of whether exchange rates fluctuate between the time you make the reservation and the time you make your trip and/or experience.

The bank may apply different fees and charges when selecting a currency other than your local currency.

13. CANCELLATION POLICY

The Traveler acknowledges and accepts the cancellation policies of Wanderloop developed in the following terms. any cancellation by the Traveler or Host, and any related refund, will be processed in accordance with the Cancellation Policy in effect at the time of your reservation.

Wanderloop reserves the right to cancel any reservation in the event that it is believed that such cancellation is necessary to prevent harm to any Traveler or in the event that the Host’s account is canceled or suspended. For these cases, Wanderloop will study each action and determine the refund to the Traveler.

Refunds will be made through the original payment method used to make the reservation. It should be understood that the return will not be immediate, this due to the times of the banks.

During the trips and/or experiences, the Hosts and Wanderloop will not be responsible for any expenses that have not been managed directly through the Wanderloop Platform.

14. CANCELLATION POLICIES FOR TRIPS 

  1. In the event that the cancellation occurs 24 hours after making the payment, a 100% refund of the deposit will be made.
  2. In the event that the cancellation occurs between the second day and the sixth day after making the payment, a refund of 30% of the deposit will be made.
  3. In the event that the cancellation occurs between the seventh day and the eleventh day after having made the payment, a refund of 15% of the deposit will be made
  4. In the event that the cancellation occurs 12 days after having made the deposit, no refund will be made.
  5. In the event that the cancellation occurs 13 days after making the deposit, the Traveler must pay Wanderloop 75% of the total price of the proposal.
  6. In the event that the trip is canceled 10 days before the start date of the trip, the Traveler agrees to pay Wanderloop the full price of the proposal.

15. CANCELLATION POLICIES FOR EXPERIENCES

  1. In the event that the cancellation occurs 24 hours after making the reservation, a 100% refund will be made.
  2. In the event that the cancellation occurs 24 hours after making the reservation and up to 10 days before the start of the experience, a 100% refund will be made.
  3. In the event that the cancellation occurs within 9 days to start the experience, no refund will be made.
  4. In the event that experiences are reserved in the following 24 hours, and cancelled, no refund will be made.

16. CANCELLATION POLICIES FOR HOTEL, CAR RENTAL OR TICKETS FOR MUSEUMS OR CONCERTS

In case of cancellation, of the scenarios described, above, the specific cancellation policies of hotels, car rental companies, museums or event organizers will apply. Our local hosts will be informed of the cancellation and will contact you to discuss available solutions to the problem.

17. AMMENDMENTS TO TRIPS AND EXPERIENCE

In case of modifications to the trip or experience, the Traveler will be able to access their profile on the Wanderloop Platform and thus make the necessary changes, in response to this, the Traveler will receive a message with an update of the cost.

18. HOSTS CANCELLATION POLICIES

Experience cancelled by the Host

If the host cancels the experience, the traveler will receive a 100% refund. Please note that canceling bookings will have a negative impact on your profile, as it will affect your confirmation rate. 

There are other issues where the traveler will receive a full refund such as:

  1. Host fails to deliver or fulfill the Experience, including because of Host technical difficulties in the case of Online Experience.
  2. Host arrives more than 15 minutes late to the Experience causing the guest to abandon the Experience.
  3. Experience presents or entails a safety or health hazard that would reasonably be expected to adversely affect a guest’s participation.

Rejected/Withdrawn/Expired Experience Requests

Each experience request must be confirmed within 48 hours. If you reject or fail to confirm the request within this time frame, the request will expire, and no payment will be made to you. This also applies if the guest withdraws the booking request before you confirm it. Be sure to click the «Confirm» button!

19. LIABILITY

Wanderloop recommends and encourages that prior to starting a trip or experience, the Traveler has medical insurance.

The Traveler accepts and acknowledges the risk that a trip implies, not only that each type of trip and/or experience may be different in attention to its nature, due to this the risk may be in greater or less quantity, therefore it is It is advisable to request information on each destination.

Wanderloop will not be responsible for any damage or loss that may arise from, or in connection with, any destination, trip and/or experience

Due to this, the Traveler assumes all risks, consequently, his family, agree to release and hold Wanderloop harmless from all liabilities and claims arising from damages of all kinds and nature, known and unknown, both pecuniary and not. pecuniary, including but not limited to illness, bodily injury, disability and death to the Traveler and/or any other participant in the trip and/or experience, which may arise out of, or in connection with, participation in a trip and/or the experience.

In the event that a minor is found on a trip and/or experience, the Traveler agrees to be legally authorized to act on behalf of the minor. In addition, the Traveler is responsible for the custody and supervision of the minor at all times during the trip and/or the experience.

Under no circumstances will Wanderloop be liable to the Traveler for any lost profits, consequential damages, direct damages, indirect damages and consequential damages.

21. TRIP CREATION PERIOD

Wanderloop informs that the vital time for the creation of a trip must be a minimum of four (4) months in advance, this in order to give the Traveler the best experience.

The Traveler must take into account that the period of four (4) months is set regarding quality of the trip or experience, taking into account the availability of hotels, restaurants and vehicle rental, therefore if it is decided to make any additional inclusions to the trip or experience that is not within this time, quality may be affected and Wanderloop will not be liable for this.


22. TRAVELER DUTIES

  1. Answer the requested questions
  2. In case of acquiring Wanderloop services, disburse the payment under the agreed conditions.
  3. Enter your Personal Data truthfully when registering on the Wanderloop Platform.
  4. Refrain from transferring your account validation data to third parties
  5. Notify Wanderloop regarding any unauthorized use of your account within the Wanderloop Platform.
  6. Refrain from using the Wanderloop Platform to carry out acts contrary to morality, law, public order, and good customs against Wanderloop and the Host.
  7. Have sufficient funds to process the payment for the requested services.
  8. Refrain from registering payment methods owned by third parties without their authorization.
  9. The Traveler acknowledges and accepts that Wanderloop may deduct the value of the debt from any payment method registered on the Wanderloop Platform

23. WANDERLOOP DUTIES

  1. Inform in a clear, updated, and sufficient way in the Wanderloop Platform the contact and identification data of Wanderloop and the Host.
  2. Inform the Traveler about the payment methods enabled within the Wanderloop Platform
  3. Send to the email registered by the Traveler the summary of the experience and/or the trip made through the Wanderloop Platform.
  4. Make the Terms and Conditions available to the Traveler.
  5. Follow and abide the current legislation on data processing.

24. TRAVELER ACCOUNT CREATION

The Traveler may browse through the Wanderloop Platform to search for experiences and/or trips without prior registration, however, to book trips and/or experiences on the Wanderloop Platform, they may need to register and complete their profile with personal data. The accounts of each Traveler are unique and non-transferable.

The opening of a Traveler Account is at the sole discretion of Wanderloop, notwithstanding the foregoing, Wanderloop reserves the right to refuse to open a Traveler Account and/or cancel a Traveler Account without notice or liability, at our sole discretion, for any reason or no reason.

The Traveler must provide accurate, current and complete information and it is his obligation to keep the information in his account updated at all times.

 We will only collect and use your personal information in accordance with law 1581 of 2012.

The Traveler is solely responsible for any claim related to any inaccurate, or incomplete information provided.

The Traveler is responsible for any activity in his Traveler Account and must maintain the confidentiality of his password. If there is any unauthorized entry, Wanderloop must be informed as soon as possible.

Within the Wanderloop Platform, different trips and experiences are related, each one with its description and its elements to include, due to this the Traveler will be able to consult any specific host about any trip or experience as well as request a specific one.

In the case of making a reservation, once the Host accepts there is a binding contract between the Traveler and the Host. Hosts are free to accept or reject your booking requests.

25. REVIEWS

Traveler will have access to Host reviews and ratings and Hosts will be able to respond to such reviews and ratings.

By submitting a review, Traveler understands and agrees that you grant Wanderloop the following rights:

  1. Permission to access, use, reproduce, display, perform, adapt, create derivative works from, modify, distribute and promote your reviews in any way, anywhere, in connection with Wanderloop’s business, without prior approval and/or notification. This permission will survive the termination of your Traveler Account on the Site.
  2. Traveler warrant and agree that you own all rights to your Reviews and that Wanderloop’s use of your Reviews does not violate the rights of any third party.
  3. In the event that a Traveler’s review violates the right of a third party, the Traveler agrees to indemnify Wanderloop in case of loss and liability that may result from the action of said third party against Wanderloop.
  4. Traveler understand and acknowledge that other users may access your reviews.
  5. The Traveler will refrain from sending reviews that contain the following information: fraudulent, false, defamatory, obscene, vulgar, offensive or promote discrimination, intolerance, racism, hate, harassment or any comments that may promote harm to a host, illegal or harmful activities and any contact details.

Wanderloop reserves the right to remove or modify any review without prior approval or notification from the Traveler when it violates any intellectual property right or these Terms and Conditions.

Reviews reflect the opinions of Travelers and not the opinion of Wanderloop. Wanderloop can verify the accuracy of the reviews, but does not guarantee that they are correct or accurate, likewise Wanderloop will not be responsible for the reviews or any type of claim of any nature that arises by virtue of any review.

26. WANDERLOOP PLATFORM RULES

The Traveler accepts the following provisions:

  1. The Wanderloop Platform will be used for the purposes indicated here and not for illegal or unauthorized purposes. It is prohibited to use the Wanderloop Platform to recruit, solicit or contact Hosts with the aim of offering them commercial offers. Additionally, the Wanderloop Platform may not be used to participate in harassment, stalking or any other inappropriate conduct.
  2. The Traveler will not provide any personal contact information, without being limited to the full name, identification number, telephone number, email and/or social networks to the Hosts.
  3. The Traveler accepts that all contacts with the Hosts prior to the Tour will be made through the Wanderloop Platform.
  4. The Traveler accepts that Wanderloop and the Hosts may contact him via email, text messages, calls and automatic calls, to the telephone number and email addresses that he provided in his account, to inform him of any updates, changes and / or information related to your reservation.
  5. In the event of a dispute that cannot be resolved directly with the Host, you may contact Wanderloop.
  6. The Traveler must be careful if he buys any product during a Trip and/or Experience. Wanderloop makes no claims about the quality, source, or other provenance of any goods that may be available for purchase during a trip and/or experience.
  7. The Wanderloop Platform will not be used to steal personal data.
  8. The Traveler accepts that by sending us ideas, suggestions and/or opinions through our surveys and/or any other alternative means, they declare and grant Wanderloop irrevocable permission to access, use, reproduce, display, perform, adapt and distribute opinions in any form, anywhere, without your prior approval and/or notice.

27. INDEPENDENCE

The Traveler understands that the relationship between Wanderloop and the Host does not entail an agency, partnership, mandate, joint account, labor relationship, nor relationships of subordination and/or dependency. Therefore, the Host will act with full technical, financial, administrative and directive autonomy in the development of any trip and/or experience.

28. INDEMNIFICATION

The Traveler agrees to defend, indemnify and hold Wanderloop harmless from any liability, claim, loss and expenses, including attorneys’ fees, that may arise, directly or indirectly, as a result of any damage by virtue of the following events:

  1. Use of Wanderloop platform and/or traveler participation in a trip and/or experience, including damage, whether to persons or property, or the death of any person.
  2. Traveler Reviews.
  3. Any violation by the Traveler to these Terms and Conditions.

29. HOST RESPONSIBILITY 

The Traveler agrees to hold the Hosts harmless in the following events:

  1. Claims of all kinds and nature
  2. Damages of all kinds and nature even if the Traveler has been previously informed of said damages or if said damages could have been foreseen.

30. DISPUTES

Any controversy or difference related to these Terms and Conditions, as well as any trip and/or experience, that could not be resolved amicably within a term of thirty (30) days, will be resolved before the ordinary jurisdiction of the Republic of Colombia. 

31. FORCE MAJEURE OR FORTUITOUS EVENT

Wanderloop will have no responsibility for the breach of the obligations it assumes, when such breach, total or partial, occurs due to events or circumstances that, according to the law, constitute force majeure or fortuitous event.

Likewise, Wanderloop will not have any responsibility in the following events: sudden changes to the entry requirements to any country (it is the duty of the traveler to be aware of these modifications), health emergencies or declared pandemics, travel restrictions imposed by governments, wars, invasions, civil wars, terrorist acts, explosions, bomb threats, rebellions, riots, natural disasters, volcanic eruptions, tsunamis, hurricanes and other weather events considered dangerous.

32. TAXES

The Host is solely responsible for determining and complying with its tax obligations, as well as reporting, collecting, remitting or including in its price any VAT and/or any other direct or indirect tax.

33. TERMINATION

These Terms and Conditions will enter into force at the time the Traveler uses the Wanderloop Platform and will remain in force unless either party decides to terminate it in response to the following events:

  1. By the Traveler sending an email to Wanderloop, which will cause a cancellation to the Traveler’s account as well as cancellation of reservations and the money will be refunded according to Wanderloop’s cancellation policy.
  2. By Wanderloop by sending an email to the Traveler, which will cause a cancellation to the Traveler’s account as well as cancellation of reservations and the money will be refunded according to Wanderloop’s cancellation policy.
  3. By Wanderloop to the traveler in case there is a breach of these Terms and Conditions.

In the event that the contractual relationship is terminated by any of the events described above, the Traveler will not have the right to restore their account.

In case of termination, the following provisions will remain in force: Liability, Cancellation Policies and Indemnity.
